Reason for the nomination: This image has been uploaded from a National Weather Service web page, where it is attributed to a third party, who is an NWS employee. The wording of the attribution "Photo provided courtesy of [name]" creates significant doubt whether this photo was taken as part of the employee's official duties.
NWS sites host a mixture of content created by the US federal government (public domain) and content created by businesses and private individuals (a wide variety of free and unfree licenses). For many years, hosting such images on the Commons was done in good faith under the rationale that:
An extensive review of this rationale in 2024 revealed that neither of these beliefs held up to scrutiny. These findings were confirmed in an RfC conducted from August to October 2024. As part of this review, I have investigated several images attributed, like this, personally to NWS employees, and in every case, the image has turned out to be the employee's personal property, to which they claim copyright. Although it is certainly possible that this image was created while on duty, it would be a highly unusual exception. Per COM:ONUS it is the responsibility of the person uploading an image to the Commons or anyone arguing for its retention here to provide evidence of permission from the copyright holder. Nevertheless, I reached out both to the creator named in the attribution (September 12) and to the NWS Norman office that published the photo (October 25) but I have received no response to either inquiry. I forwarded both attempts at contact into the same VRT ticket: (ticket:2024110410009811) Since this is an image created in the US after 1989 and is attributed to a creator eligible for copyright, this is a presumably unfree file and we must delete it as a precaution under COM:PRP.
